Question regarding Temporary Social Security Disability Benefits and closed periods
I read your website and came across a link for CAN I GET TEMPORARY BENEFITS?
I never wanted temporary benefits, but my lawyer told me to file that way since I worked for 3 months after my case was started in 2011-2012.
I did a closed period of disability. I only got disability for a little while and he had me refile. It has been two years and my finances are in ruin and my children and I need an income.
He wont do an expedite it and I have no help.
depressed and devasted,
I am sorry that this has happened to you. Social Security disability is not a temporary disability program and as such there are no temporary benefits to be paid while you are awaiting a disability decision.
A closed period is not temporary disability benefits, it is a period of time that the Administrative law judge determined that you met the requirements for Social Security disability.
Many people get a closed period of disability and then file a new disability claim if their disabling condition has not improved. Perhaps your lawyer felt the three months of work would possibly cause you not to be awarded any kind of disability benefit. I cannot comment on that not knowing all the facts of the claim.
I am not sure where you are in the disability process but am I correct in assuming you are waiting for another hearing of the new claim you filed? I am not sure who will not expedite it? Your lawyer or the judge? It is hard to give an answer to this because I do not have enough information.
I wish I had better information to give you at this time.
