How hard will it be to get disability?



 
It can be fairly difficult to win and get disability benefits in Kentucky or any state. The process is equally hard regardless of state because SSDI and SSI are federal programs. The differences encountered by claimants filing for disability in one state versus another will typically regard how long it takes to get a decision on a claim, how long it takes to get a disability hearing, and approval rates on claims.

What makes the process of trying to get disability hard? First of all, there is the fact that most claims are denied on the disability application. This is usually over 70 percent. Most claims are likewise denied on the request for reconsideration appeal, which is the first appeal in the process unless your particular state allows claimants to go immediately to the hearing level after being denied on the initial claim.

High rates of denial make the disability claim system seem daunting. However, most claimants who pursue their claim to the level of a disability hearing with an ALJ, or administrative law judge, will have a much higher chance of being given a disability award, particularly if the case is welll-prepared and presented with regard to proving that the case meets the SSA definition of disability.
