How does a Workmans Compensation claim settlement affect eligibility for Social Security disability benefits?



A workman's comp settlement does not affect eligibility for Social Security disability benefits, but it does affect disability benefit amounts.

Social Security disability benefits are offset by WC payments or settlements. If there is a settlement involved, the settlement most likely will be prorated over your lifetime and the proration amount will be used to offset your disability benefit amount.

Note: it isn't a bad idea for both the attorney for your Social Security case and your worker's compensation attorney to be aware of each other's cases. Your worker's comp lawyer will want the clincher agreement to be worded appropriately so that your disability benefit amount is impacted in a way that is most favorable to you.
