There is a lot of confusion with regard to retroactive back pay and back pay. All back payment of disability benefits for both SSDI and SSI is tied to the filing date. Social Security Disability (SSDI) has the potential for retroactive disability benefits in that a person could have up twelve months of retroactive disability benefits beginning with the filing date and back payment months going forward with the disability claim until it is approved for benefits.

On the other hand, Supplemental Security Income disability (SSI) does not have retroactive disability benefits because it is a need based disability program. All back payment benefits are determined by the filing date going forward with the disability claim until it is approved.



Most disability applicants have the potential for very large disability benefit back payments because most disability applicants will have to use the Social Security Disability appeal process to be approved for disability benefits. Administrative law judge disability hearings are backlogged at most hearing offices across the nation and it is not unusual to wait a year or more for a hearing. Consequently, disability back payment benefits are accruing over that entire time.

In conclusion, the SSI filing date determines when the month potential disability benefits begin and the back payment of benefits can only go back to that filing date.
