If you receive unemployment benefits, can you still get disability?



 
The simple answer to this question is that you can file for Social Security Disability benefits if you receive unemployment. You may even qualify for the SSI disability program depending on the amount of your unemployment benefits.

The problem with filing for disability while receiving unemployment does not lie with the Social Security Administration. However, it is a potential problem for the Unemployment Security Commission if you file for disability while receiving their weekly benefits. It is logical really; if you file for unemployment benefits you are stating that you are ready, willing, and able to take employment. When you file for disability you are claiming that you are so severely impaired by your disabling condition that you are unable to work.

It is impossible for you to be both. You might want to wait for your unemployment to runs out before filing for disability. Or, you could file for disability and notify the Unemployment Commission you have done so. The problem with the latter is that it will stop your unemployment.

Many individuals determine that the risk is negligible, so they file for Social Security while continuing to receive their unemployment. Most do not have a problem, however a few have been criminally charged and ordered to repay their unemployment.
