What if I have not gotten my disability award letter yet?



 
Here is a question that was sent in by a visitor to the site:

Topic: Disability award letter not received yet

Question: "I had a trial on the 14th for disability and was approved. The administrative law disability judge deemed me disabled as of four years prior. I have not received my disability award letter as of yet. I am curious how my back pay is going to work. Any positive input will be greatly appreciated."

Without knowing any of the particulars of your case such as 1. When did you file for disability, and 2. Did you file for SSI disability, Social Security Disability, or did you have a claim filed under both programs, it would be impossible for me to comment as to how many months of SSD or SSI back pay you may be owed.

In the case of an SSI only claim, you can only be paid back to the date of your application and if you have an SSD claim, there is the potential for receiving back pay for retroactive months, though the five months of the waiting period takes those five months of back pay away from you (SSI is not subject to a waiting period at all). None of these issues are actually that relevant to your question the way it was asked, however.



It simply sounds as though you will be receiving a significant amount of back pay for several years' time. As to when you will get it, I would imagine that you will get your official award notice very soon. If you are approved for disability at an administrative law judge hearing, your case, of course, is send to the payment center for processing. Also, how much of your back pay you will receive upfront (meaning the full amount at once, or in disbursements) will depend on which program your claim is filed in.

If you have representation, your representative or disability lawyer will get a copy of the award notice as well. Typically, you would speak to this individual when you receive the award notice.
