RATES OF APPROVAL FOR TEXAS DISABILITY CLAIMS



What are the rates of approval for disability claims in Texas at the application, first appeal, and hearing levels?



 
In the state of Texas, while approval rates at the application and reconsideration (the first appeal) levels are fairly much in line with the national average, at the disability hearing level the approval rate is markedly lower than in many other states.

According to recent year statistics, the national approval rate and Texas approval rate for disability applications is approximately 32 percent. The national approval rate and Texas approval rate for reconsideration appeals is approximately 12 percent. The average hearing approval rate (average because Texas has multiple hearing offices) is 47 percent while the the national average is 56 percent.

Additionally, the rate of approval for claims in Texas that have been previously approved and are undergoing review is substantially lower than the national average. 74 percent of claims are continued at their review nationally while, according to recent year statistics, only 64 percent of reviewed claimants have their benefits continued.


Common questions about filing for disability in Texas
Note: All approved cases are periodically reviewed through the CDR review process. CDR stands for continuing disability review and such reviews occur every few years according to preset schedules based on how likely SSA thinks a person may be to experience improvement in their prognosis.

So, while it is arguably no more difficult to initially win benefits in Texas at the application level, it is harder to win disability benefits at a hearing. It is also harder to keep one's disability benefits in Texas when their claim is reviewed.
